Heard the learned counsel on either side.

2. The petitioner was working as Clerk in the fourth respondent society. She was terminated vide order dated 08.06.2022. Aggrieved by the same, the petitioner filed an appeal before the second respondent under Clause 32 of Special Bye-Laws of the fourth respondent society. The incumbent who is occupying the office of the appellate authority was the very same official passed surcharge order against the petitioner under Section 87 of the Act. The petitioner has therefore approached this Court with a demand that the appellate authority must be someone who is not connected with the subject matter.

3. The contention of the learned counsel appearing for the petitioner is well founded. The elementary principle of natural justice is that the appellate authority is not in any way connected with the subject matter. The petitioner is not alleging personally against the appellate authority. He is only alleging bias as to the subject matter.

4. The first respondent is directed to nominate some other official in the rank of the Deputy Registrar to dispose of the petitioner's appeal on merits and in accordance with law. I make it clear that I have not gone into the merits of the matter. With this direction, this writ petition stands disposed of. No costs. Consequently, connected miscellaneous petition is closed.
