Respondent PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the respondent to issue certificate of cultivation to the petitioner's proprietary concern for exporting sandalwood plants with Coco pit by considering the petitioner's representation, dated 21.12.2016 within a stipulated time to be fixed by this Court.

The petitioner/a Nursery Garden, is said to have obtained an order from abroad for export of sandalwood plants with Coco pit. According to the petitioner, for making such export, they have to obtain a certificate of cultivation from District Horticulture Officer or District Forest Officer, as contemplated under the export policy. Therefore, the petitioner made an application on 21.12.2016 before the respondent, seeking for issuance of such certificate. As the said application is not disposed of so far, the present writ petition is filed.

2.Needless to say that it is for the respondent to consider and decide as to whether the petitioner is entitled to such certificate or not. This Court, therefore, at this stage, is not expressing any view on the claim made by the petitioner. However, this writ petition is disposed of only with a direction to the respondent to consider the application of the petitioner, dated 21.12.2016, and pass orders on the same on merits and in accordance with law, within https://hcservices.ecourts.gov.in/hcservices/

a period of four weeks from the date of receipt of a copy of this order. No costs.
