Respondents 3rd respondent is impleaded vide order dated 28.03.2017 PRAYER: Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus to direct the respondent to consider the representation of the petitioner dated 06.09.2016 and to take appropriate steps to permit the Mini Bus Jeniffer (Malaiyeri Amman) bearing No TN.49.P.9318 up to Thanjavur Old Bus Stand in accordance with the Transport Circular Letter in R.No.90919/E2/2000 dated 29.11.2000, enabling the general public to get the benefit of the introduction of the Mini bus scheme. ORDER

[Order of the Court was made by K.K.SASIDHARAN, J.] The petitioner has come up with this writ petition to direct the respondents to consider his representation and take appropriate measure to permit the mini bus by name Jeniffer, bearing Registration No.TN-49-P-9318 upto Thanjavur Old Bus Stand in accordance with the Circular dated 29.11.2000, issued by the Transport Department.

2.The affidavit filed in support of the writ petition clearly indicates that the petitioner is only a name lender and it is a proxy litigation. There is no question of directing the respondents 1 and 2 to permit the private mini bus operator to ply the bus upto a particular destination. We are, therefore, of the view that no direction as prayed for by the petitioner, could be given in this writ petition.

3.The writ petition is dismissed. No costs.
