ORDER
[Order of the Court was made by A.SELVAM, J.] This Writ Petition has been filed under Article 226 of the Constitution of India praying to direct the respondents to dredge all the water tanks and restore its water channels which situate in the jurisdiction of the third respondent, by way of issuing a Writ of Mandamus.
2.It is averred in the petition that within the jurisdiction of the third respondent so many water tanks are available wherein no dredging work has been done and in some water tanks so many encroachments are in existence. Under the said circumstances, a representation dated 22.11.2016 has been given by the petitioner and a reply containing false facts has been given and therefore the present petition has been filed for getting the relief sought therein.
3.On the basis of the relief sought in the Writ Petition, for ascertaining the present situation of all water tanks which situate within the territorial jurisdiction of the third respondent, this Court has appointed an Advocate Commissioner and accordingly, he inspected all the tanks and filed his report and in fact this Court has perused the Commissioner's report and ultimately found that in so many tanks dredging have not been done.
4.The learned Additional Government Pleader appearing for the respondents has contended to the effect that the first respondent viz., the District Collector, Sivagangai has submitted a detailed report wherein it has been clearly stated about dredging works already done.
5.Considering the fact that on the basis of the Commissioner's report dredging work has not been done properly in all the tanks which situate within the jurisdiction of the third respondent, this Court is inclined to pass the following order. 6.In fine, this Writ Petition is allowed without costs and the respondents 1 to 3 are strictly directed to perform dredging works of all the water tanks and channels which situate within the jurisdiction of the third respondent within a period of one year.
