ORDER

Heard the learned counsel on either side.

2. The petitioner had applied to the first respondent for issuance of passport. Since the petitioner had been involved in the criminal case the application had not been processed.

3. The learned Additional Government Pleader appearing for the respondents 2 and 3 clarifies that the petitioner was convicted and sentenced to pay fine alone in a case arising under Sections 294(b) and 323 IPC. Another case has been registered against the petitioner and it is still pending at the FIR stage. In these circumstances, there cannot be any impediment for processing the petition mentioned application. The first respondent is directed to process the same and issue passport to the petitioner subject to the fulfilment of the usual formalities.

4. This writ petition is allowed. No costs.
