ORDER

This Criminal Original Petition has been filed to direct the 1st respondent to transfer the investigation in Crime No. 21 of 2023 dated 07.02.2023 from the 4th respondent police to 3rd respondent and to be investigated by any competent officer under 3rd respondent herein.

2. The Deputy Superintendent of Police attached to Nilakkottai is present before this Court and stated that in pursuance of the representation that was made by the petitioner to Superintendent of Police, made allegations against the investigation Officer namely the fourth respondent, he was directed to take further investigation by order dated 28.02.2023. Now he has taken further investigation. After taking further investigation, he continued the same and so far 12 witnesss have been examined by him, is also confirmed by going through CD file.

3. According to the learned Additional Public Prosecutor, the investigation is going in a proper direction. There is no question of transferring the same.

4. Even though the allegation has been made against the fourth respondent, who is suspended, according to the learned Additional Public Prosecutor, now new officer has taken further investigation. The petitioner is directed to cooperate with the investigation officer to complete the process of investigation. 2/4

The above said investigation shall be completed with two months from the date of receipt of copy of this order. Let the above said investigation may be undertaken under the direct supervision of the second respondent herein.

5. With the above said direction, this Criminal Original Petition stands disposed of.
