For Respondent : Ms. Anantha Devi, Government Advocate (Crl.Side) PETITION FOR MODIFICATION Under Sec.439(i)(b) of Cr.P.C PRAYER :- To modify the 2nd condition as and when required instead of to report before the respondent police daily at 10.30a.m until further orders in Cr.M.P.No.5955/2019 dated 27.06.2019 on the file of Prl Ses Judge, Tirunelveli and allow this petition. ORDER : The Court Made the following order :- This petition has been filed by the accused seeking to modify the condition imposed by the learned Principal Sessions Judge in Cr.M.P.No.5955 of 2019 dated 27.06.2019.

2. The learned counsel for the petitioner would submit that as per the order passed by the Sessions Court, the petitioner has surrendered before the concerned Magistrate and executed bail bond on 28.06.2019 and subsequently the petitioner was suffering from chicken pox and hence he could not comply with the conditions and therefore he prayed to modify the said condition. https://hcservices.ecourts.gov.in/hcservices/

3. The petitioner is not having grievance against the main

order passed by the learned Sessions Judge, Tirunelveli. He has accepted the said order and complied with the conditions imposed by the Court for a certain period and now he has filed this petition that he is suffering from chicken pox, hence he is not able to continue to comply with the said condition. In such a case, he can very well approach the Sessions Court for the relief of relaxation of the said condition.

4. With the aforesaid observations, the Criminal Original petition is disposed of.
