ORDER

Though the prayer in this writ petition is for issuance of a Writ of Mandamus, directing the 1st respondent to consider the representation of the petitioner dated 25.01.2017 in the light of the judgment of this Court dated 01.09.2016 pronounced in W.P.(MD) Nos.30539 to 30541 of 2016 for disbursement of pension, gratuity, leave salary, special GPF with all attendant benefits, when the matter came up for hearing, learned counsel for the petitioner would submit that it is suffice, if a direction is issued to the 2nd respondent to consider and pass orders on the petitioner's representation dated 25.01.2017, seeking the abovesaid relief, within a time frame.

disposed of directing the 2nd respondent to consider the petitioner's representation dated 25.01.2017 in the light of the principles laid down by this Court in the judgement dated 01.09.2016 made in W.P.(MD)Nos.30539 to 30541 of 2016, and pass appropriate orders in accordance with law, if there are no legal impediments, within a period of one month from the date of receipt of a copy of this order. Since the petitioner is under suspension, this Court makes it very clear that the respondents shall complete the disciplinary proceedings, if any, initiated against the petitioner, expeditiously, as pendency of the criminal case is not a bar for proceeding with the departmental proceedings. No costs.
