O R D E R
The petitioner seeks for a Writ of Mandamus, directing the respondents to appoint the petitioner for the post of Anganwadi Helper in Panchayat Union Anganwadi, Candiyan Street, Karambakudi, by considering her representation, dated 16.09.2018. 2.The learned Special Government Pleader takes notice for the respondents.
3.By consent, the writ petition itself is taken up for final disposal.
4.The learned counsel appearing for the petitioner submitted that though the petitioner has participated in the interview, no action has been taken by the respondents sofar. Hence, she made a representation dated 16.09.2018 to the first respondent in this regard. Since the said representation has not been considered by the respondents, the petitioner has come forward with the present writ petition.
5.According to the petitioner, after accepting the petitioner's application for the post of Anganwadi Helper, the respondents have not taken any steps to process her application and appointed some other candidate in the said post, which is illegal and hence, a direction may be given to the respondents to appoint her as Anganwadi Helper in the Panchayat Union Anganwadi, Candiyan Street, Karambakudi.
6.Even though no counter has been filed by the respondents, it has been contended that the petitioner has not applied for the post of Anganwadi Helper and the post of Angawadi Workers the applications have been called for, for which, the required qualification is S.S.L.C. It is further contended that the petitioner has not at all applied for the post of Anganwadi Helper and having applied for the post of Anganwadi Worker, the learned counsel is trying to mislead this Court stating that she has made an application for the post of Anganwadi Helper. It is further stated that after the completion of interview, with regard to 8 Blocks, the results have been announced and the results of the remaining Blocks will be announced within a period of one month from today. It is further contended that the petitioner has not applied for the post of Anganwadi Helper, but she has applied only for the post of Anganwadi Worker and making a plea before this Court, as if, she made an application for the post of Anganwadi Helper, which cannot be appreciated.
7.For the incorrect submission made by the learned counsel for the petitioner before this Court, though it is a fit case for imposing cost, taking note of the fact that the petitioner has come from a downtrodden Community, this Court is not inclined to impose any cost.
8.In the result, this writ petition fails and the same is dismissed. No costs.
