ORDER: The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police pursuant to a Non-Bailable Warrant issued against him by the learned Judicial Magistrate No.I, Thoothukudi, in P.R.C.No.56 of 2026, seeks anticipatory bail.

2. Admittedly, a Non-Bailable Warrant was issued against the petitioner on 02.04.2026 and the case is an old one. In such circumstances, this Court is of the view that the petitioner can appear before the learned Judicial Magistrate No.I, Thoothukudi and file a petition under Section 70(2) of the Code of Criminal Procedure, 1973 [corresponding to Section 72(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023] seeking recall of the Non-Bailable Warrant issued against him.

3. Therefore, with a direction to the petitioner to file a petition under Section 70(2) of the Code of Criminal Procedure, 1973 [corresponding to Section 72(2) of the Bharatiya Nagarik Suraksha Page No. 2 of 4

Sanhita, 2023] seeking recall of the Non-Bailable Warrant and with a further direction to the learned Judicial Magistrate No.I, Thoothukudi, to consider the same on the very same day, this Criminal Original Petition is disposed of.
