PETITION FOR ANTICIPATORY BAIL Under Sec.482 of BNSS PRAYER :- For Anticipatory Bail in Crime No.79 of 2025 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioners/A2, A5 & A6, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 8(c) and 20(b)(ii)(A) of NDPS Act r/w. Section 77 of JJ Act in Crime No.79 of 2025 on the file of the respondent police, seek anticipatory bail.

2. The case of the prosecution is that on 16.05.2025, based on secret information, the respondent police found that the 1st accused was selling ganja near the Ramarajpuram Government School locality and recovered 56 grams of ganja. Hence, the present case.

3. The learned counsel for the petitioners submitted that the petitioners are innocent persons and have not committed any offences as alleged by the prosecution. They have been implicated in this case solely based on the confession of the 1st accused. He further submitted that the petitioners are ready to abide by any conditions that may be imposed by this Court. Hence, he seeks anticipatory bail to 2/4

the petitioners.

4. The learned Government Advocate (Criminal Side) submitted that there are totally six accused persons in this case and the petitioners have been arrayed as A2, A5 and A6. A1 and A3 were arrested and subsequently released on bail, while A4 was arrested and is still in custody. He submitted that A2, A3, and A4 went to Dindigul and purchased the contraband, which was then given to A5 and A6, who converted the same into small packets. He further submitted that six previous cases have been registered against the 2nd accused, one previous case against the 5th accused, and no previous cases against the 6th accused. However, he opposed the grant of anticipatory bail to the petitioners.

Considering the facts and circumstances of the case, and considering the gravity of the offence allegedly committed by the petitioners, and also taking note of the fact that there are six previous cases registered against the 2nd accused and there is one previous case registered against the 5th accused, and that the 4th accused was arrested and is still in custody, this Court is not inclined to grant anticipatory bail to the petitioners at this stage.
