Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the 2nd respondent to correct the extent in survey sketch as per settlement deed, dated 28.06.2017 in Survey No.1248/13A measuring extent of 0.06.25 Hectares by considering the petitioner's representation, dated 13.12.2021 within the time stipulated by this Court.

ORDER
This Writ Petition has been filed seeking a direction to the second respondent to correct the extent in the survey sketch for the property situated in Survey No.1248/13A, by considering the petitioner's representation dated 13.12.2021.

According to the learned counsel for the petitioner, the total extent of land mentioned in the survey sketch for Survey No.1248/13A is more than 0.06.25 hectares, as per the patta as well as the settlement deed. Hence, the petitioner submitted a representation dated 13.12.2021 seeking rectification of the incorrect extent mentioned in the survey sketch, however, the same has not been considered. Therefore, he has filed the present Writ Petition.

The learned Government Advocate appearing for the respondents would submit that, subsequent to the representation submitted by the petitioner, the first respondent called for a report from the second respondent and, thereafter, no orders have been passed due to the pendency of this Writ Petition. 2/4

Without expressing any opinion on merits of the matter, the first respondent is directed to consider the petitioner's representation, dated 13.12.2021 and pass final orders on its own merits within a period of twelve weeks from the date of reciept of copy of this order, after affording reasonable opportunity to the petitioner.
