This Criminal Original Petition is filed seeking a direction to the respondent Police to expedite the investigation in Crime No.34 of 2023 1/4
and file the final report within a stipulated time
2. The learned counsel appearing for the petitioner submits that the accused in this case is an Advocate and the petitioner is his client. Since the said Advocate has assaulted the petitioner inside the Court Hall, the petitioner lodged a complaint against the said Advocate and the same was also registered in the in Crime No.34 of 2023, for the offence under Sections 294(b) and 323 IPC, on the file of the respondent Police. He further submits that though the case has been registered in the month of February 2023, it is kept pending without any progress. Since the accused is an Advocate, the respondent Police is not taking any action against the accused.
3. Justice must not only be done but it must also be seen to be done. But, in this case, though the case has been registered in the month of February 2023, the investigating agency has not taken any steps to file the final report so far. The grievance of the petitioner is 2/4
that since the accused is an Advocate, the respondent Police is not taking any steps against him. It is the responsibility of the respondent police to erase this impression from the mind of the petitioner.
4. Therefore, this Criminal Original Petition is allowed with a direction to the respondent police to complete the investigation and file the final report in Crime No.34 of 2023, within a period of eight weeks from the date of receipt of a copy of this order. 08.07.2024 ogy NCC : Yes / No.
