ORDER : The Court made the following order :- The petitioners/A9 & A10, who were arrested and remanded to judicial custody on 27.02.2026, for the offences punishable under Sections 103(1), 311 of BNS, 2023 @ 103(1), 190, 191(2), 310(3), 311, 49 and 61(2) of BNS, 2023, in Crime No.75 of 2026, on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the petitioners and the deceased were relatives. On 19.02.2026, the petitioners and the other accused were staying in a cottage at Kodaikanal. They were in drunken stage and they have created a problem with the deceased. They have tied the deceased in the cottage, murdered him and looted 2 sovereigns of gold chain and 1 1⁄2 sovereigns of gold ring and escaped from the scene of occurrence. Hence, this case.
3.The learned counsel for the petitioners submitted that the petitioners are innocent persons and they have not committed any offences as alleged by the prosecution. Based on the confession statement of the co-accused, the petitioners have been implicated in this case. The learned counsel further submits that the earlier petitions filed 2/7
by the first petitioner were dismissed by this Court, by orders, dated 08.04.2026 and 27.04.2026. This is the third petition filed by the first petitioner along with the second petitioner for grant of bail. The petitioners are in jail from 27.02.2026.
4. The learned Additional Public Prosecutor submitted that the petitioners are A9 and 10 in this case. They are mother and son and on their instigation only, the other accused have committed the crime. Considering the gravity of the offence, the earlier applications filed by the first petitioner were dismissed by this Court. He strongly objected for grant of bail to these petitioners.
5.Taking into consideration of the facts and circumstances of the case and also considering the period of incarceration suffered by the petitioners, this Court is inclined to grant bail to the petitioners, subject to the following conditions:
6. Accordingly, the petitioners are ordered to be released on bail 3/7
on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties, each for a like sum to the satisfaction of the learned Judicial Magistrate, Kodaikanal and on further conditions that :- [a] the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity.
[b] the first petitioner shall report before the Inspector of Police, Virugampakkam Police Station, Chennai, daily at 10.30 a.m., until further orders. The second petitioner shall report before the respondent police as and when required. Both the petitioners are directed to co-operate for the investigation. [c] the petitioners shall not abscond either during investigation or trial.
[d] the petitioners shall not tamper with evidence or witness either during investigation or trial. [e] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioners in accordance with law as if 4/7
the conditions have been imposed and the petitioners released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560]. [f] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 BNS.
