Respondents PRAYER: Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the first respondent to take action to remove the encroachment in the petitioner landed property situated in SF.No.1/16, Kayangulam Group 84, Kuttithinni Village, Thambanusilangulam Sub Division, Sivagangai Taluk and District after conducting the enquiry pursuant to the order passed by the second respondent in his proceedings in Na.Ka.Pi4/15508/2013 dated 06.05.2014 and in the mean time allow the petitioner to uprooting the Seemai Karuvelam Trees from his landed property based on the representation of the petitioner dated 07.01.2017. *********** [Order of the Court was made by K.K.SASIDHARAN, J.] The petitioner filed this writ petition to direct the first respondent to take action to remove the encroachment in respect of the land in SF.No.1/16, Kayangulam Group 84, at Kuttithinni Village, Thambanusilangulam Sub Division, Sivagangai Taluk and District.

2. This Court, taking into account the affidavit filed in support of the writ petition, directed the petitioner to implead the proper parties by order dated 28.02.2017. The matter was adjourned on various occasions. Till now, the petitioner has not filed any application pursuant to the direction issued by this Court. https://hcservices.ecourts.gov.in/hcservices/

3. The Writ Petition is dismissed, on account of non-joinder

of necessary parties. It is always open to the petitioner to file a comprehensive Writ Petition, after impleading the parties against whom eviction is sought. No costs.
