For Respondent : Mr.K.Suyambulinga Bharathi, Government Advocate (Crl.Side) PETITIONS FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C COMMON PRAYER :- For Anticipatory Bail in Crime No. 343/2020 on the file of the respondent police COMMON ORDER : The Court made the following order :- The petitioners/accused, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 147,148,332,353,294(b),392 and 307 of IPC seeks anticipatory bail.
2. The case of the prosecution is that the on receiving secret information about fishing sea cucumber when the defacto complainant https://hcservices.ecourts.gov.in/hcservices/ 1/2
No. 3/674, South St and other police officials made a search in their locality the petitioners along with other accused persons said to have abused the defacto complainant and also assaulted the police officials.
3. The learned Government Advocate(Crl.Side) raised serious objections by stating that while the police officials discharging their duties they were attacked by all the accused persons and the mobile phone of the police officer was also taken away by the accused persons and some of the accused persons in this case pushed the police officials and attacked them.
4. Investigation is going on and granting anticipatory bail at this juncture is not preferable.
5. Hence these petitions stands dismissed.
