ORDER

The petitioner, the 1st accused in Crime No.75 of 2022, has moved this petition seeking a direction to the learned Chief Judicial Magistrate, Sivagangai, to accept his surrender and recall the warrant, which is pending against the petitioner dated 24.07.2024 in S.C.No.1 of 2023.

2. The learned counsel appearing for the petitioner submits that the trial Court has issued a Non-bailable Warrant as against the petitioner on 24.07.2024 and the petitioner is inclined to file an application to recall the Non-Bailable Warrant issued by the trial Court. In the event, if the petitioner is remanded, then, he may be affected. The petitioner has also given an undertaking that he is ready to co-operate for trial.

3. The learned Government Advocate (Crl. Side), on instructions, submits that the warrant was not issued on 24.07.2024 as projected by the petitioner and it was issued on 25.01.2023. He further submits that the petitioner has assaulted a police officer on duty during adal padal programme in the temple festival and in order to avoid the proceedings, 2/4

he also absconded to abroad.

4. Considering the submissions made by the learned Government Advocate (Crl. side), this Court is not inclined to entertain this petition. Accordingly, this Criminal Original Petition is dismissed. However, there shall be a direction to the respondent Police to issue a look-out circular and secure the petitioner. The respondent Police shall ensure that the trial is not delayed on account of appearance of the petitioner. 17.06.2025 Index : Yes / No.
