O R D E R

This Writ Petition has been filed, seeking a direction to the respondents to release the withheld provident fund(GPF), earned leave encashment, extraordinary leave on personal affairs and gratuity to the Petitioner in the light of the law laid down by this Court in Judgement reported in W.A.(MD)No.141 of 2016, dated 23.09.2016 confirming order made in W.P(MD)No.11133 of 2015 dated 8.7.2015.

2.Mr.A.K.Baskarapandian, learned Special Government Pleader takes notice for the respondents. By consent of both parties, the Writ Petition itself is taken up for final disposal at the admission stage itself.

3.It is not in dispute that the issue is covered by Judgment reported in W.A.(MD)No.141 of 2016, dated 23.09.2016. 4.Applying the same principle, the respondent concerned is directed to disburse the withheld provident fund(GPF), earned leave encashment, extraordinary leave on personal affairs and gratuity, which are admissible to the Petitioner, if he is otherwise eligible. The reason for which his service is extended need be completed at the earliest, both criminal and departmental proceedings, as expeditiously as possible. The passing of this order will not preclude the department to complete its departmental proceedings apart from the criminal proceedings. 5.With the above directions, the Writ Petition is disposed of. No costs.
