[Order of the Court was made by R.SUBRAMANIAN, J.] Mr.S.P.Maharajan, learned Special Government Pleader takes notice for the respondents 1 to 4 and Mr.P.Thilak Kumar, learned Government Pleader takes notice for the fifth respondent.
2. With the consent of both sides, the writ petition is taken up for final hearing at the admission stage itself.
3. The impugned notices have been issued under the provisions, viz., Sections 131, 131(4), 222 and 242 of the Tamil Nadu Panchayats Act, 1994, by the President of Vilacheri Panchayat.
4. We have repeatedly held in several cases that the Panchayat President has no power to evict encroachments in view of the specific language of the Section 131(2) of the Tamil Nadu Panchayats Act, 1994. It is for the
Panchayat President to seek action under the Tamil Nadu Land Encroachment Act, 1905, by the revenue department.
5. In view of the above legal position, this writ petition stands allowed. The impunged notice dated 17.05.2023 is set aside. It is open to the panchayat to take action in accordance with law.
