ORDER

These Criminal Miscellaneous Petitions have been filed, praying to suspend the sentence imposed upon the petitioner by the learned Chief Judicial Magistrate, Tiruchirappalli in C.C.No.794 of 2022 dated 09.01.2026, which was confirmed by the learned II Additional District and Sessions Judge, Tiruchirappalli in C.A.No.No.29 of 2026 dated 06.04.2026 and to exempt the petitioner from surrendering before the Court below.

The learned counsel appearing for the petitioner submitted that the petitioner has been convicted by the trial Court on 09.01.2026, and the trial Court sentenced him to undergo rigorous imprisonment for a period of 3 years and to pay a fine of Rs.5,000/-, in default to undergo simple imprisonment for a period of 6 months for the offence punishable under Section 420 of IPC and that the period undergone already has to be set off under Section 428 of Cr.PC. Aggrieved over the said conviction, the petitioner filed C.A.No.29 of 2026, before the learned II Additional District and Sessions Judge, Tiruchirappalli and the lower Appellate Court vide order dated 06.04.2026, dismissed the 2/6

appeal confirming the judgment passed by the Trial Court. Challenging the above conviction and sentence, petitioner has filed Criminal Revision Petition in Crl.RC(MD)No.839 of 2026 before this Court along with the instant miscellaneous petitions seeking suspension of sentence, bail and exemption from surrender.

The learned counsel for the petitioner submitted that there are several infirmities in the prosecution case, and also there are contradictions in material particulars between the evidence of the prosecution witnesses. He further submitted that he also paid fine amount as per the order of trial Court

4. This Court has carefully considered the rival contentions put forward by either side and also perused the materials available on record.

5. Considering the fact that there are arguable points raised in revision and taking into consideration, facts and circumstances of the case and that it is likely to take a while before the revision is finally heard, this Court is inclined to grant suspension of sentence, bail and exempt the petitioner from surrendering before the trial court, on the following conditions, till the disposal of the above Criminal Revision:- 3/6

i) The petitioner shall execute a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with one regular surety and one blood surety each for a like sum to the satisfaction of the Chief Judicial Magistrate, Tiruchirappalli;

ii) Petitioner and sureties shall affix their photographs and Left Thumb Impression in the bond and the above said Court may obtain a copy of their Aadhaar card or Bank pass Book to ensure their identity; iii) Petitioner shall appear and sign before the learned Chief Judicial Magistrate, Tiruchirappalli, daily for a period of two weeks and thereafter, first working day of every English calendar month at 10.30 a.m., until further orders;

iv) In case, petitioner is not able to appear before the said Court on any day, he shall make arrangements to file an application under Section 317 Cr.P.C. (corresponding to 355 B.N.S.S) and shall appear before the said Court on any other day in lieu of the date of his absence, as directed by the said Court.

6. Accordingly, these Criminal Miscellaneous Petitions are ordered. 07.05.2026 (1/2) rgm 4/6
