Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, to direct the respondent to rectify the petitioner's date of birth in the Birth Certificate records as "20.04.1981" instead of 21.04.1981 as per Hospital Birth Register and petitioner's School & College Certificate & Aadhar Card and consequently issue birth certificate by considering petitioner's representation dated 02.06.2022 within the time fixed by this Court.

O R D E R

This writ petition has been filed for a direction directing the respondent to rectify the petitioner's date of birth as "20.04.1981" instead of "21.04.1981".

2. Heard the learned counsel appearing on either side and perused the materials placed before this Court.

3. The petitioner was born on 20.04.1981 at Biswas Hospital, Marthandam Main Road, Kanyakumari District. Accordingly, her birth was registered by the registering authority. Her School Certificate and College Certificate, Aadhar Card and Passport also consisting the petitioner's date of birth as 20.04.1981. In fact the hospital register shows that the petitioner was born on 20.04.1981, however, in the manual ledger the respondent has wrongly enter the petitioner's date of birth as 21.04.1981. Therefore, on the application submitted by the petitioner seeking the birth certificate, it was not considered since the petitioner did not mention the correct date of birth in the application.

4. On a perusal of all the certificates produced by the petitioner revealed that the petitioner date of birth is mentioned as 20.04.1981. 2/4

In view of the above, the respondent is directed to rectify the petitioner's date of birth as 20.04.1981 in their port and to issue the date of birth certificate as she was born on 20.04.1981 within a period of two weeks from the date of receipt of a copy of this order.
