ORDER

This Criminal Original Petition has been filed seeking a direction to the 2nd respondent to give police protection to the petitioner's life and limb, based on her complaint dated 04.06.2024 and 02.07.2024.

2. The learned counsel appearing for the petitioner submits that the petitioner has submitted an application before the revenue officials for identifying the property and for marking boundaries, based on which, the petitioner's property has been identified and boundaries were marked, in the presence of the revenue officials. Only thereafter, the petitioner has proceeded with the construction of a house. But, the 3rd and 4th respondents have prevented the petitioner from constructing a house. Therefore, the petitioner has lodged a complaint before the respondent Police and also filed this petition seeking police protection. 2/5

The learned Additional Public Prosecutor submits that the complaint of the petitioner was duly attended and a criminal case has been registered against the 3rd and 4th respondents in Crime No.21 of 2024 on 05.04.2024. He further submits that in this case, final report has also been filed before the Judicial Magistrate Court, Kamuthi and the same has been taken on file in C.C.No.156 of 2024.

4. Considering the said submission, this Court feels that adequate action has been taken by the respondent Police on the complaint of the petitioner. Therefore, this Court is not inclined to entertain this petition seeking police protection. However, whenever any offence has been committed by the private respondents, it is always open to the petitioner either to lodge a separate complaint or to workout her remedy in C.C.No.156 of 2024 which is pending against the private respondents, before the learned Judicial Magistrate, Kamuthi. 3/5
