PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus calling for the entire records relating to the impugned communication issued by the respondent herein in its File No.TR107940 6631516, Letter Ref.No.SCN/304235189/16, dated 12.07.2016 and to quash the same and consequently direct the respondent herein to replace and reissue the Passport bearing No.A7885324 in the form of newly Electrically Typed format to the petitioner within a stipulated time.

This Writ Petition is filed challenging the proceedings, dated 12.07.2016 issued by the respondent.

Perusal of the impugned proceedings would show that it is only a notice calling upon the petitioner to provide suitable explanation and furnish details regarding circumstances under which she has suppressed the material information in her passport application. When such being the proceedings, I do not think that the petitioner is justified in approaching this Court and filing this writ petition, without giving explanation to the respondent and explaining the circumstances under which the details were furnished in the passport application. present writ petition is not maintainable against the impugned notice.

3. Accordingly, this Writ Petition is dismissed without going into the merits of the matter, only on the ground of maintainability. However, the petitioner is given liberty to give the explanation before the respondent, within a period of fifteen days from the date of receipt of a copy of this order. It is open to the petitioner to make all the submissions before the respondent. No Costs. Consequently, connected Miscellaneous Petition is closed.
