The present Writ Petition is filed for issuance of a Writ of Mandamus, directing the respondent herein to permit the petitioner to participate in the opening of bid scheduled on 09.08.2016 at 12.00 hours along with bidding documents in respect of "Rehabilitation and Improvement of Vaigai Dam of Andipatti Taluk of Theni District under Drip - Renewal and Replacement of River Sluice Shutter No.3, 6 & 7 and repairs to spillway gate and Hoisting arrangement of spillway gate 1 to 7 Nos at Vaigai dam in Theni District, under DRIP" and consequently, direct the respondent herein to consider the bidding documents of the petitioner on merits and in accordance with law. https://hcservices.ecourts.gov.in/hcservices/
2. The learned Additional Government Pleader, on instructions, would submit that the petitioner has also participated in the opening of the bid and, therefore, nothing survives in the Writ Petition.
3. The learned counsel for the petitioner would submit that totally three bidders participated in the tender, however, the respondent has not declared the bid amount of the petitioner, which is lower than the other bidders.
4. Considering the prayer sought for in the Writ Petition and the submission of the learned Additional Government Pleader, the Writ Petition is dismissed as infructuous. However, the petitioner is at liberty to file a fresh Writ Petition, if he is aggrieved by the finalization of the tender. No costs. Consequently, the connected miscellaneous petitions are closed.
