O R D E R

[Order of the Court was made by S.VAIDYANATHAN, J.] This contempt petition has been filed alleging willful disobedience of the order, dated 08.11.2022, made in W.P.(MD) No.9652 of 2022.

2. When the matter was taken up for hearing, Mr.P.Thilakkumar, learned Government Pleader, who takes notice for the respondents, would submit that the encroachments, as alleged by the petitioner, have been removed.

3. However, the learned counsel for the petitioner refuted the above submission of the learned Government Pleader. According to the

learned counsel for the petitioner, the neem tree is not yet removed. Originally, it was a plant, now, it has become a big tree. That apart, the encroacher has also planted teak wood plants disturbing the access to the house of the petitioner.

4. Everyone should be encouraged to have more greeneries by planting saplings, which will be useful for everyone. The neem tree, which is sought to be removed by the petitioner, is at the edge of the road. Hence, we find no contempt on the part of the respondents. If the other encroachments, like steps and drainage tanks, have not been removed as contended by the petitioner, he is entitled for removal of the same, if they are in violation of the orders of this Court. The teak wood plants, which are also sought to be removed by the petitioner, are directed to be shifted to the edge of the road.
