ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 126(2), 127(2), 115(2), 118(1) and 351(3) @ 191(2), 191(3), 126(2), 127(2), 115(2), 118(1) and 351(3) of BNS, in Crime No.39 of 2026 on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that due to previous enmity, on 13.02.2026, the accused persons assaulted the defacto complainant, pushed him in his private parts and also criminally intimidated him. Hence, the complaint.

3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offences as alleged by the prosecution. He further submitted that the petitioner is ready and willing to abide by any conditions which may be imposed by this Court. Hence, he seeks anticipatory bail to the petitioner. She would further submit that the co-accused had already been granted bail in Crl.O.P.(MD) No.7451 of 2026, dated 30.04.2026. 2/5

4.The learned Government Advocate (Crk.Side) submitted that the injured died and the respondent police are now taking steps to alter Sections. Hence, he vehemently opposed for grant of anticipatory bail to the petitioner.

5.Considering the fact that the injured has died and there exists a possibility of alteration of the penal provisions either under Section 302 IPC or under Section 304 IPC, depending upon the outcome of the investigation and medical evidence and also considering the gravity of the offence and the stage of investigation, this Court is not inclined to grant the relief of anticipatory bail to the petitioner. 6.This Criminal Original Petition stands dismissed, accordingly. 06.05.2026 mm 3/5
