O R D E R

The petitioner seeks the reissuance of a birth certificate by including the name of his son, Vishnuprakash, in such birth certificate and also to correct his name as N.Ramamoorthi instead of N.Ramamoorthathi as wrongly mentioned therein.

2. The petitioner states that his elder son Vishnuprakash was born on 19.10.1991. During the relevant period, his wife Guruvammal was working as a nurse at Sankaralingapuram Health Centre. His son was born at Sankaralingapuram village. The birth of his son was duly registered on 21.10.1991 under the Registration of Births and Deaths Act,1969. Upon registration, the Village Administrative Officer, Sankaralingapuram, issued a certificate indicating the name and date of birth of his son. At present, the petitioner's son works at Singapore and requires a birth certificate. Upon approaching the second respondent in such regard, a birth certificate was issued on 15.07.2021. However, it is stated that such birth certificate contains an error as regards the petitioner's name and does not mention the name of the petitioner's son. The present writ petition is filed in such facts and circumstances.

3. Mr,P.Subbaraj, learned counsel for the State, accepts notice on behalf of both the respondents. He submits that the second respondent may be directed to consider the petitioner's request for reissuance of the birth certificate.

4. The petitioner has enclosed the certificate issued by the Village Administrative Officer, Sankaralingapuram. Such certificate indicates the name of the petitioner. It also indicates the date and place of birth. In addition, the petitioner has enclosed the Aadhaar card of his son and the SSLC and HSC certificates issued to his son. Such certificates also contain the correct name of the petitioner's son R.Vishnuprakash. As such, the petitioner has made out a case for the consideration of the application for reissuance of the birth certificate.

5. Accordingly, the petitioner is permitted to submit a fresh application to the second respondent by enclosing the documents submitted before this Court as also an authorization from his son. Such fresh representation shall be submitted within a period of two weeks from the date of receipt of a copy of this order. Upon receipt thereof, the second respondent is directed to take all the aforesaid documents into consideration and take a reasoned decision within a period of two months from the date of receipt of such fresh representation.
