ORDER
This Writ Petition is filed to quash the impugned order passed by the first respondent vide his Proceedings in Na.Ka.No.6376/E2(2)/2016, dated 17.02.2017.
2.Heard the learned counsel for the petitioner and the learned Special Government Pleader appearing for the respondents. https://hcservices.ecourts.gov.in/hcservices/
3.The learned counsel appearing for the petitioner by relying upon a medical certificate pertaining to the petitioner's daughter submitted that the respondents may consider the health condition of the petitioner's daughter and that the transfer of the petitioner without considering the health condition of the petitioner's daughter is not appropriate. He further submits that this Court may direct the respondents to consider the representation which would be made by the petitioner on the basis of his daughter's health condition.
4.The impugned order of transfer is an administrative transfer and hence, this Court is not inclined to entertain this Writ Petition on merits. When the transfer is purely on administrative grounds or on administrative exigencies, it is well settled that the Court will not interfere with the order of transfer. Hence, the Writ Petition is dismissed. However, considering the submission made by the learned counsel for the petitioner, this Court direct the petitioner to submit his representation within a period of two weeks from the date of receipt of a copy of this order.
On receipt of such representation, the respondents shall consider the same and pass orders on merits and in accordance with law, within a period of four weeks thereafter. No costs. Consequently, the connected miscellaneous petition is closed.
