The Writ Petition has been filed in the nature of certiorarified mandamus, relating to refusal check slip issued by the third respondent/Sub Registrar, Sub Registrar Office, Sanarpatti, Dindigul District, dated 17.02.2020, by which, the said respondent refused to register two documents presented for registration and kept pending with pending numbers P.20/2018 and P.21/2018 and for a consequential relief to direct the third respondent to register and release the aforementioned documents. 2.In the affidavit filed in support of the writ petition, it has been stated that the petitioner had executed a partition deed and a sale deed among the family members and presented them before the third respondent for registration. The third respondent had kept them pending and stated that 'No objection Certificate' must be issued by the Tahsildar. 2/5
3.The learned counsel for the petitioner points that such 'No objection Certificate' had already been directly forwarded by the Tahsildar to the Sub Registrar Office.
4.A direction is given to the petitioner to go over to the office of the third respondent and the third respondent is directed to examine the NOC issued by the Tahsildar, Dindigul North, Dindigul District in Mu.Mu.No. 2617/2016/B2, dated 20.04.2016 and Mu.Mu.No.2618/2016/B2, dated 20.04.2016 and examine whether the two communications are related to the lands of the petitioner, for which, documents have been presented and thereafter, do the needful. If the Sub Registrar is having any doubts then he/she must issue notice to the petitioner herein, seek necessary clarification and thereafter, examine the records and do the necessary needful. 5.Accordingly, this Writ Petition stands disposed of.
