Respondent PRAYER: Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Certiorarified Mandamus calling for the records relating to the impugned order dated 16.02.2017 issued by the respondent and quash the same, consequently direct the respondent to grant permission and protection to conduct Musical orchestra to be held on 02.04.2017, 03.04.2017, 05.04.2017 and 06.04.2017 in the eve of Panguni Thiruvizha of Sri Muppidathiamman Thirukoil, Sivagurunathapuram, Veerakeralam Pudur Taluk, Tirunelveli District.

ORDER

[Order of the Court was made by A.SELVAM, J.] This writ petition has been filed under Article 226 of the Constitution of India praying to call for records relating to the order dated 16.02.2017 passed by the respondent and quash the same and also for directing the respondent to give permission for conducting Musical Orchestra Programme in the place mentioned in the petition, by way of issuing a writ of certiorarified mandamus. 2.Mr.D.Muruganandam, learned Additional Government Pleader, has taken notice for the respondent.

3.It is seen from the impugned order that the permission sought by the petitioner has been rejected only due to law and order problem. Further it is seen from the impugned order that the respondent has permitted to conduct other events. 4.Considering the reason given in the impugned order, this Court is of the view that the same is liable to be quashed. 5.In fine, this writ petition is allowed without costs and the impugned order dated 16.02.2017 passed by the respondent is partly quashed. The respondent is directed to look into the representation once again and pass suitable order within a period of two days.
