ORDER
This Writ Petition is disposed of at the time of admission after hearing the learned counsel for the petitioner, learned Central Government Standing Counsel for the first respondent and learned Government Advocate (Crl.Side) for the respondents 2 and 3.
2. This Writ Petition has been filed by the petitioner for a direction to direct the first respondent to issue passport to the petitioner in response to the application No.MD1067489806125, dated 10.03.2025.
3. Mr.V.B.Sundhareshwar, learned Central Government Standing Counsel takes notice on behalf of the first respondent. Mr.K.Sanjai Gandhi, learned Government Advocate (Crl.Side) takes notice on behalf of the 2/5
respondents 2 and 3.
4. It is informed by the learned Government Advocate (Crl.Side) for the respondents 2 and 3 that the petitioner has been arrayed as sole accused in FIR in Crime No.49 of 2022 before the third respondent, for the alleged offences under Sections 279, 337 of IPC @ Sections 279, 338 of IPC.
5. The learned Government Advocate (Crl.Side) for the respondents 2 and 3 would also submit that the complaint has been taken on file and the petitioner has been charge sheeted in S.T.C.No.419 of 2023, before the learned Judicial Magistrate, Thirupuvanam, Sivagangai district.
6. Considering the same, there cannot be any positive direction to the first respondent to issue passport to the petitioner as prayed for. However, liberty is given to the petitioner to approach concerned Judicial Magistrate for appropriate relief for the first respondent to process the petitioner's passport application.
