PRAYER:- Petition - filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the 1st and 2nd respondents to mutate the revenue records of the lands pertaining to the lands in S.No.405/21 of Vaviarendhal Village, Thiruppuvanam Taluk, Sivagangai District, by considering the enquiry report of the 3rd respondent by his proceedings in Na.Ka.A1/282/2019 dt 09.05.2019 based on the representation of the petitioner dt 21.10.2019.

ORDER

This writ petition has been filed seeking for issuance of writ of mandamus directing the respondents to mutate revenue records and to issue patta based on the enquiry report submitted by the third respondent through proceedings dated 09.05.2019.

2. Heard Mr.S.Balakarthick, learned counsel for the petitioner and Mr.R.Ragavendran, learned Government Advocate for the respondents.

3. The learned Government Advocate appearing for the respondents submitted that the property is now categorized as Natham in the revenue records.

4. The learned counsel for the petitioner submitted that the third respondent had already conducted an enquiry in this regard and had submitted a report to the second respondent through the proceedings dated 09.05.2019 and 2/4

had recommended for recording the name of the temple, namely, Rakkatchi Amman Temple in the revenue records. The learned counsel for the petitioner therefore submitted that this can be considered by the second respondent and acted upon.

5. Taking into consideration the facts and circumstances of the case, there shall be a direction to the second respondent to deal with the representation made by the petitioner on 21.10.2019 and consider the same in light of the report submitted by the third respondent through proceedings dated 09.05.2019 and take a final decision within a period of six weeks from the date of receipt of a copy of this order. The petitioner is directed to make a fresh representation to the second respondent along with all relevant documents and also a copy of this order.
