For Respondent : Ms.M.AnanthaDevi, Government Advocate (Criminal Side) PETITION FOR ANTICIPATORY BAIL Under Section 438 of Cr.P.C PRAYER :- For an Anticipatory bail in Crime No.316 of 2011 on the file of the respondent police.

ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioner and the learned Government Advocate(Criminal Side) appearing for the respondent.

2. The petitioner apprehending arrest at the hands of the respondent police for the offences punishable under sections 457 and 380 of I.P.C., in Crime No.316 of 2011 on the file of the respondent police, seeks anticipatory bail.

3. The learned counsel for the petitioner states that crime was registered in the year 2011 and pending for the past nine years. Thus, the petitioner is to be released on anticipatory bail. https://hcservices.ecourts.gov.in/hcservices/

4. The learned Government Advocate (Criminal side) objected the 1/2

CRL OP(MD). No.12884 of 2020 petition by stating that the case is regarding theft of idol from the temple situate at Suseendram in Kanyakumari District. Two accused were already arrested and the investigations are in progress. The police is in the process of conducting investigations in a wider manner as there was no progress in the case for the past ten years. The custodial interrogation of the petitioner is just and necessary to receive more information about the theft of temple idols.

5. In view of the serious objections raised by the learned Government Advocate (Criminal side), it is not preferable to consider the petition for anticipatory bail. Accordingly, this Criminal original Petition stands dismissed.
