Respondents Writ Petition filed under Article 226 of the Constitution of India for the issuance of a WRIT OF Mandamus directing the respondents to provide alternative job to the petitioner (Driver) in the same scale of pay in the light of the Section 47 in the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation), Act 1995.

ORDER

The petitioner herein, who is presently working as Driver in the Transport Corporation from 02.05.1997 and said to be suffering from pain in the spinal-cord, underwent MRI/CT Scan and has been advised by the Doctor to do only light works, hence, he has made a representation to the respondents to consider his case under Section 47 of the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation), Act https://hcservices.ecourts.gov.in/hcservices/ 1995. Since the said representation has not been considered so far, he has come to this Court.

2. A perusal of the MRI Scan report produced before this Court shows that Pre and para vertebral soft tissues are normal and no other document has been filed to show that the petitioner is having any abnormal ailment. Therefore, this Court is not inclined to entertain the writ petition. Accordingly, this writ petition fails and the same is dismissed. No costs.
