For Respondent : Mr.S.Ravi, Additional Public Prosecutor ORDER : The Court made the following order :- The petitioners, who are accused Nos.5, 3, 2, 4 and 1 respectively, apprehending arrest at the hands of the respondent police for the offences punishable under Sections 3(5), 296(b), 115(2) and 351(2) of BNS 2023, in connection with the case in Crime No.155 of 2026 on the file of the respondent police, have filed this petition seeking anticipatory bail.

2. The case of the prosecution is that on 03.05.2026, due to money dispute, the petitioners said to have assaulted the defacto complainant and his family members and also caused injuries. Hence, the case.

3. The learned counsel for the petitioners submits that the petitioners are innocent persons and they have not committed any offence as alleged by the 2/7

prosecution. In fact, on the date of occurrence, the defacto complainant and his henchmen came in a drunken condition, picked up quarrel with the petitioners and assaulted them, for which, the petitioners gave a complaint before the respondent Police and the same has been registered in Crime No. 154 of 2026 for the offence under Section 296(b), 118(1) of BNS and Section 4 of Women Harassment Act. Therefore, he seeks anticipatory bail to the petitioners. The learned counsel further submits that the 4th petitioner's name has been wrongly mentioned as Manikandan, S/o.Mareeswaran, instead of Manikaran, S/o.Mareeswaran.

4. The learned Government Advocate (Crl. Side) would submit that it is a case and counter case and the injured has been discharged from the hospital. He would further submit that the petitioners are not having any previous case.

5. Considering the facts and circumstances of the case and also considering the fact that it is a 3/7

case and counter case and the injured has been discharged from the hospital, this Court is inclined to grant anticipatory bail to the petitioners, subject to certain conditions.

Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance, on condition that the petitioners shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only)each, with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Vilathikulam, Thoothukudi District, within a period of fifteen days from the date on which the order copy is made ready and on further conditions that:

[a]the petitioners and the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhaar card or bank pass book to ensure their identity;

[b] the petitioners shall report before the respondent police daily at 10.30 a.m. for a period of 15 days and 4/7

thereafter, as and when required for interrogation.

[c]the petitioners shall not tamper with the evidence or witness either during investigation or trial;

[d]the petitioners shall not abscond either during investigation or trial;

[e]On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioners in accordance with law as if the conditions have been imposed and the petitioners are released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560];

[f]If the accused thereafter abscond, a fresh FIR can be registered under Section 269 of BNS.
