ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 3(1), 4 (2)(a), 4(2)(c), 5(1)(a), 5(1)(d) and 7(2)(c) of Immoral Traffic (Prevention) Act, 1956, in Crime No.737 of 2018, seeks anticipatory bail.

2.The case of the prosecution is that on 23.09.2018 at about 06.30 p.m the respondent inspected the premises situated in the ground floor of the petitioner's hotel and fount that a healthy centre namely Poonarjani Kerala Ayurvedic Health Centre is functioning on rental basis. On enquiry, the respondent police came to know that one Mahesh Chandran is running the massage centre and he has taken the ground floor for a rental basis from the petitioner and he was running a prostitution business under the guise of running a massage centre. It is also further alleged that the accused person having involved in this activity with the knowledge of the petitioner herein. Hence, the complaint. 3.The learned counsel appearing for the petitioner would submit that the petitioner is the landlord of the said hotel and admittedly, he leased out the premises to one Mahesh Chandran. https://hcservices.ecourts.gov.in/hcservices/

Except that, the petitioner nothing to do with the crime. Hence, he prays for anticipatory bail.

4.The learned Additional Public Prosecutor appearing for the respondent submitted that the investigation is pending. 5.Taking note of the facts and circumstances, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate No.VI, Madurai and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. Scrupulously.

6.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
