ORDER

This Criminal Original Petition has been filed for issuing direction to the respondent not to harass the petitioners and their family members under the guise of enquiry with respect to the false complaint given against them.

2. The learned counsel appearing for the petitioners submitted that originally the property in dispute belongs to one Thirumalaiammal, she sold the portion of the property to these petitioners and later, father of the petitioners filed suit in O.S.No.54 of 2006 for declaration and the same was decreed. In the meantime legal heirs of the above said vendor viz., Ponnusamy filed an appeal in A.S.No.186 of 2018 before the Sub Court, Dindigul. Pending said process, the said Ponnusamy gave a complaint as if the petitioners encroached the property.

3. The learned Additional Public Prosecutor would submit that during the course of enquiry, the said Ponnusamy appeared and gave statement that he will work out the remedy in the pending appeal itself. 2/4

So on the above said basis, the said complaint was closed and hence, nothing survives for adjudication.

4. In view of the said submission, this Criminal Original Petition is disposed of as infructuous.
