O R D E R
[Order of the Court was made by G.K.ILANTHIRAIYAN, J.] The prayer in the petition is to quash the impugned order passed by the first respondent in No. 174724/ThaKu.4/2026, dated 09.04.2026 and consequently grant six days emergency leave without police escort to the petitioner's husband Ravichandran, S/o.Pitchaiyan (PID No.473939) now confined at Central prison, Tiruchirapalli forthwith considering the representation dated 14.03.2026.

It is the case of the petitioner that her husband was convicted by the Principal District and Sessions Court, Thanjavur in S.C.No.4 of 2013 dated 25.11.2026 and sentenced to undergo ten years rigorous imprisonment for the offence under Section 376(2)(f) of IPC. Aggrieved over the same, the convict has preferred an appeal before this Court and the same was partly allowed and the conviction imposed was modified to seven years for the offence under Section 376 of IPC. The petitioner submitted an application seeking emergency leave for a period of six days. After considering the request
made by the petitioner, the first respondent granted emergency leave to the convict with escort. The petitioner being a poor person, she could not afford the cost for escorts.

In view of the above, the condition imposed in the order dated 09.04.2026 directing the convict to go on emergency leave with escort is modified and the convict shall go on emergency leave without escort. However, the convict is directed to comply with the usual conditions imposed by the jail authorities and he should also report before the second respondent police daily at 10.30 a.m., and 05.30 p.m. till the completion of leave period. He shall duly comply with the conditions and return to the prison on expiry of the leave period. It is also made clear if the petitioner causes any disturbance to the victim or her family members, the fifth respondent is at liberty to register First Information Report as against the petitioner and take appropriate action in accordance with law.
4. Accordingly, the order of the first respondent dated 09.04.2026 is quashed in sofar as the ordering escort alone and the Writ Petition is disposed of.
