ORDER
This writ petition has been filed challenging the impugned Garnishee orders passed by the 2nd respondent under Section 131(3)of the Code on Social Security, 2020, dated 27.01.2026 and 10.02.2026 2.
Mr.C.Karthick, learned counsel takes notice for respondents 1, 2 and 12. Mr.N.Dilip Kumar, learned counsel takes notice for respondents 4 and 5. Since no adverse order is going to be passed against the respondents 3 and 6 to 11, notice to them is dispensed with. By consent of both parties, this writ petition is taken up for final disposal at the stage of admission itself.
3. The petitioner has already raised this issue before the Labour Court, Tirunelveli in E.S.I.O.P.Nos.76 of 2026 and 147 of 2025. In fact, the petitioner has also obtained interim orders of stay of the proceedings in C19 recovery certificate dated 30.09.2025. In the meanwhile, Garnishee orders have been passed. As such, the petitioner 4/6
ought to have approached the Labour Court under Section 75(g) of the Employees' State Insurance Act, 1948. Hence, this Writ Petition is not maintainable and the same is liable to be dismissed.
