The writ petition has been filed for issuance of a Writ of Mandamus, directing the respondents to grant permission to conduct Aadal Paadal programme from 07.00 pm to 11.30 pm on 13.08.2016 and to provide adequate police protection in Arulmighu Sri Valavanthal Amman Temple is celebrating festival.
2.Mr.D.Muruganandham, learned Additional Government Pleader, takes notice for the respondents. By consent, the writ petition itself is taken up for final disposal.
3.Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader appearing for the respondents. 4.The learned counsel appearing for the petitioner would submit that the festival is being conducted by the villagers regularly in order to promote harmony during the above said festival period and in connection with that festival, cultural event is being conducted; that a representation was given to the 2nd respondent, but, however, the same was not considered by the 2nd respondent so far and hence, the petitioner is before this Court with this writ petition. The learned counsel appearing for the petitioner would further submit that as the aforesaid festival is celebrated in a peaceful manner by the villagers, there will be no untoward incident on account of this celebration. https://hcservices.ecourts.gov.in/hcservices/ 5.The learned Additional Government Pleader appearing for the respondents, on instructions, would submit that recently there was an
incident of murder, pursuant to which, a case has been registered under Section 302 IPC and therefore, the respondents are reluctant in granting permission. It is not known, whether this case arose out of the dispute in connection with the festival. If it is not so, the respondent may consider the representation.
6.In view of the submission made by the learned Additional Government Pleader, the Writ Petition is disposed of with a direction to the 2nd respondent to consider the representation of the petitioner dated 08.08.2016 and pass orders on merits and in accordance with law as expeditiously as possible, as the cultural event is scheduled to be conducted on 13.08.2016. No costs.
