RESPONDENT/RESPONDENT Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to modify the condition in 8(a) imposed on the Petitioner by this Honble Court in Crl.O.P.(MD).No.10554 of 2023 dated 15.06.2023 particularly the petitioner shall deposit the Original title. Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.RANJITH N, Advocate for the petitioner and of M/S.THANGA ARAVINDH B GOVERNMENT ADVOCATE (CRIMINAL SIDE) on behalf of the Respondent the court made the following order:- This Criminal Miscellaneous Petition has been filed to modify the condition in condition No.8(a) imposed on the petitioner by this Court in Crl.O.P.(MD)No.10554 of 2023 dated 15.06.2023. 2.

This Court has granted anticipatory bail to the petitioner in Crl.O.P.(MD)No.10554 of 2023, dated 15.06.2023 and this Court directed the petitioner to deposit the original title deed which stands in her name or in her relative's name or in her friend's name worth about Rs.4 crores along with the property valuation certificate from the authorities competent before the concerned Court without prejudice to her defence and on receipt of such original deeds, the respondent is at liberty to proceed as against the property in accordance with law and on such deposit, the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.I, Trichy. 3.

The learned counsel for the petitioner would submit that the petitioner is a coolie and she could not able to arrange any property to the tune of Rs.4 crores, since she is inside and no property stands in the name of the petitioner, her friends or her relatives.

4.The learned counsel for the de-facto complainant would submit that the petitioner had so many property in Tamil Nadu as well as Karnataka and that apart, she has cheated so many persons and A1 is still absconding.

5.Considering the above facts and circumstances and also considering the facts that the petitioner has cheated more than Rs.10 crores and she committed very serious offence as against the society, this Court is not inclined to modify the condition imposed against the petitioner.

6.In the result, this Criminal Miscellaneous Petition is dismissed.
