representation dated 09-05-2026 within a time period which may be stipulated by this Court.

O R D E R

[Order of the Court was made by G.K.ILANTHIRAIYAN, J.] The prayer in the petition is to direct the first respondent to grant three months time to the Petitioner for vacating the impugned premises situated in Survey Nos. 297/2, 297/3, 312/1, 312/2, 312/3, 312/4, 312/5, 312/6, 312/7, 312/8, 312/9 located at T.N.Pudhukudi, Puliyankudi, Tenkasi by considering the Petitioners representation dated 09-05-2026 within a time period which may be stipulated by this Court.

2. It is seen that by depositing the title deeds, the second respondent had borrowed loan from the first respondent and committed default. Therefore the first respondent continued with the SARFAESI proceedings and the said premises is now under the possession of the first respondent by taking action under the SARFAESI proceedings. Now the petitioner being a tenant, submitted a representation before the first respondent seeking three months extension to vacate the premises.

The learned counsel appearing for the petitioner submitted that the petitioner is running an educational institution namely Jeeva Institute of Allied Health Science wherein, courses such as Diploma in patient care, Diploma in X-ray imaging Technology, Diploma in Health Inspector, Diploma in Hospital Administration, Diploma in Medical Lab Technology are being provided and about 90 students are being educated. Therefore, he sought for three months time to vacate the said premises situated in Survey Nos. 297/2, 297/3, 312/1, 312/2, 312/3, 312/4, 312/5, 312/6, 312/7, 312/8, 312/9 located at T.N.Pudhukudi, Puliyankudi, Tenkasi.

4. Considering the request made by the learned counsel appearing for the petitioner and also on hearing the learned counsel appearing for the first respondent, this Court is inclined to extend the time till 31.05.2026 to vacate the premises.

5. The learned counsel appearing for the petitioner also undertakes to vacate the premises on or before 01.06.2026.

6. In view of the same, the first respondent is directed to permit the petitioner to occupy the said premises till 31.05.2026 and if the petitioner fails to vacate the premises, the first respondent is directed to take appropriate action as against the petitioner for vacating the said premises in accordance with law.
