ORDER : The Court made the following order :- The petitioners/accused apprehending arrest at the hands of the respondent police for the offence punishable under section 420 IPC in Crime No.25 of 2020 on the file of the respondent police, seek anticipatory bail.
2.The petitioners are the father and son. The allegations against the petitioners are that they have received a sum of Rs.25,00,000/- (Rupees Twenty Five Lakhs only) from the defacto complainant and promised to purchase a vehicle for the defacto complainant. Thereafter, neither a vehicle was purchased nor the amount so received was returned back. Thus, the defacto complainant lodged a complaint.

CRL OP(MD). No.12882 of 2020 3.When the matter was heard by the learned Session Judge, Ramanathapuram, an opportunity was provided to the petitioners to settle the matter by repaying the borrowed amount. Twice opportunities were given to the petitioners for the purpose of refund of the money received from the defacto complainant. Though the petitioners have promised to settle the matter, they have not yet settled so far and thereafter, they filed the present petition seeking bail.
4.Under these circumstances, the trust worthiness of the petitioners cannot be made upon and further the investigation is in progress. Thus, it is not preferable to enlarge the petitioners on bail.
