ORDER
This writ petition has been filed challenging the impugned notice issued by the 4th respondent in his proceedings in Ka.No.U.Mi.Po/E.Kaa/Nagar Pon/Ko.Pothu/A.No.64/2026 dated 26.03.2026, thereby directing the petitioner to produce the no objection certificate from the 2nd respondent.
2. By consent of both sides, the writ petition is taken up for final disposal at the stage of admission itself.
3. Heard the learned counsel for the petitioner, learned Government Advocate for the respondents 1 to 3 and the learned counsel for the 4th respondent.
4. The petitioner is in occupation of small extent of land comprised in SF No.624 of Kandiyanatham Village of Pudukottai District. The petitioner submitted a representation for reclassification of the said land 2/5
as 'Natham' so as to regularise her occupation. However, without considering the same, the petitioner was served with an eviction notice. Therefore, the petitioner approached this Court by filing WP(MD) No. 17090/2025 and this Court by an order dated 24.06.2025 directed the District Collector to consider the petitioner's case if she is eligible for alternative site or accommodation. In the meantime, the petitioner has also submitted a representation to reclassify the subject land as Natham. However, it was not considered and her assessment of house tax was also cancelled. Since the petitioner has put up a house in a land, which is classified as Government poramboke, in order to disconnect the electricity service connection, the petitioner was served with a notice by the 4th respondent by directing the petitioner to obtain no objection certificate from the 2nd respondent, failing which, the electricity service connection would be disconnected. The said notice is challenged in this writ petition.
5. It is seen that the petitioner has not produced the no objection certificate from the 2nd respondent so far and as such the 4th respondent is taking steps to disconnect the electricity service connection for the house 3/5
situated in the aforesaid survey number.
6. Admittedly, the petitioner constructed a house in the Government poramboke land and house tax was also cancelled. Further the petitioner's application is also pending before the first respondent for allotment of alternative place.
7. In view of the above, this Court finds no infirmity or illegality in the notice issued to the petitioner herein dated 26.03.2026. Accordingly, the writ petition is dismissed as devoid of merits.
