4.N.Ravikumar : Respondents PRAYER: Petition is filed under Section 482 of Criminal Procedure Code praying to direct the respondents No.1 to 3 to give necessary police protection to the life and limb of the petitioner, his family members and his property comprised in Survey Nos.711/1B, 711/2A, vide Patta No.477 situated at South Valliyoor Part-II, Radhapuram Taluk, Tirunelveli District on the basis of the petitioner's representation dated 24.04.2019. ORDER
This petition has been filed seeking police protection to the petitioner.
2. According to the petitioner, a civil dispute is pending between the petitioner and the fourth respondent. Earlier the petitioner has made a complaint against the fourth respondent in Crime No.261 of 2017 and the same is pending investigation. https://hcservices.ecourts.gov.in/hcservices/
Pending investigation, now the fourth respondent is threatening the petitioner and preventing him from fencing his lands. The complaint lodged by the petitioner has not even enquired by the respondent police. Hence, the petitioner has filed the present petition.
3. The learned Government Advocate (Crl.Side) appearing for the official respondents, on instructions, would submit that the petitioner has given two complaints against the fourth respondent. Both are registered and investigation regarding first complaint is pending. As far as the second complaint is concerned, the second respondent conducted enquiry on the said complaint and closed the same directing the parties to approach the civil Court to obtain necessary orders.
4. Considering the fact that the petitioner's first complaint is pending investigation and the second complaint is enquired and closed as civil dispute, the prayer as such sought for by the petitioner in the present petition cannot be granted. Accordingly, this Criminal Original Petition is dismissed.
