Respondents (Respondents 1 to 4 are removed vide Court Order Dated.09.12.2024 in Writ Petition) PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a writ of mandamus, to direct the Respondents No.1 to 3 to take action on the Respondents No.4 to 7 and their management and also to refund deposited Amount of Rs.1,00,000/- plus Rs.50 000/-totally Rs.1.5 lakhs with 12-18% interest as per RBI guidelines with last year school fee. ORDER

This Writ Petition is filed, praying for issuance of a writ of mandamus, to direct the Respondents No.1 to 3 to take action on Respondents No.4 to 7 and also to refund the deposited Amount of Rs.1,00,000/- plus Rs.50,000/- totally Rs.1.5 lakhs with 12-18% interest, as per RBI guidelines. (*)2. The case of the petitioner is that the sixth respondent, who is the Headmaster of St.Joseph Matriculation School, Venthanpatti, Pudukottai District, has collected a sum of Rs.1,50,000/- towards school fee for ten years in advance from the petitioner for the studies of his daughters, namely, G.S.Rethna and G.S.Kanishka, on the promise of providing education up to 12th Standard, but the said school failed to provide education to his daughter.

The further case of the petitioner is that the said school has no educational licence, it lacks infrastructure and does not have transport, water and other facilities. In this regard, he submitted several representations to the authorities concerned, including the one, dated 23.08.2023, to the school management, but of no avail. Therefore, he has filed this Writ Petition.

Considering the facts and circumstances of the case, the petitioner is directed to submit a fresh representation to the authority concerned for redressal of his grievance within two weeks from today, in which event, the said authority is directed to pass appropriate orders on the representation of the petitioner on merit and in accordance with law, within a period of two weeks thereafter.

4. Writ Petition is disposed of accordingly. No costs. Consequently, the connected W.M.P.(MD) No.13972 of 2024 is closed.
