ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 189(2), 296(b), 281, 121(1), 109, 303(2) of BNS, 2023 r/w.Section 21(1) of Mines and Minerals (Development and Regulation) 1/4

Act, 1957 in Crime No.191 of 2025 on the file of the respondent police, seek anticipatory bail.

2. The case of the prosecution is that on 04.06.2025, the respondent police had conducted vehicle checkup, at that time, they identified the accused person illegally transported river sand in a vehicle. When the officials attempted to stop the vehicle, the driver allegedly tried to run over the officials. Further, the accused persons used abusive language against the officials and issued threats of serious harm. Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner is innocent person and he has not committed any offences as alleged by the prosecution. The petitioner is ready and willing to abide any conditions which may be imposed by this Hon'ble Court. Hence, he seeks anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal Side) submitted that this petitioner and other accused persons have illegally transported river sand, when the same was questioned by the officials, they trying to abuse them with abusive language and threatened them with dire consequences. In this case, this petitioner is the owner of vehicle, this petitioner is the second accused. In this case, investigation is in preliminary stage. Hence, he strongly opposed to grant anticipatory bail to the 2/4

petitioner.

5. Considering the nature and gravity of the offence and considering the fact that investigation is in preliminary stage, at this stage, this Court is not inclined to grant anticipatory bail to the petitioner.
