ORDER

The Civil Revision Petition invoking under Article 227 of the Constitution of India has been filed to set aside the order in C.C. Sr. No. 303 of 2023 on the file of the Circuit Bench of the Tamil Nadu State Consumer Disputes Redressal Commission, Maudrai dated 29.05.2023. 2.

Heard Mr. P.Ganapathi Subramanian, Learned Counsel for the Petitioners, Mr. Ponnaiah, Learned Counsel for the Respondents and perused the materials placed on record, apart from the pleadings of the parties. 3.

Against the order passed by the State Consumer Disputes Redressal Commission, there is an alternative appeal remedy under Section 21B of the Consumer Protection Act before the National Consumer Commission by way of revision.

Having due regard to that settled legal position, Learned Counsel for the petitioner seeks permission of this Court to withdraw the Civil Revision Petition with liberty to resort to the aforesaid procedure. 2/4

5. In view of the same, the Civil Revision Petition is dismissed as withdrawn granting such liberty. It is made clear that no view has been expressed by this Court on merits of controversy involved, and all contentions are left open to be raised before the National Commission in accordance with law. No costs.
