For Respondent : A.Robinson, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C. PRAYER :- For Anticipatory bail in Cr.No.1/2019 on the file of the respondent police.

ORDER : The Court Made the following order :- The petitioner is figuring as A3 in the FIR registered against him for the offences under Sections 120 B, 406, 420 and 506(i) of IPC and Section 5 of the Tamil Nadu Protection of Interest of Depositors (In Financial Establishment) Act, 1997, in Crime No.1 of 2019 on the file of the Inspector of Police, EOW, Dindigul. The petitioner apprehends arrest at the hands of the respondent police. Therefore, he seeks anticipatory bail.

2.Heard the learned counsel for the petitioner and the learned Government Advocate (crl.side) for the respondent police. 3.It is seen that the defacto complainant had paid a huge sum of money to the first accused Trust represented by the second accused P.Selvaraj. The petitioner is said to have introduced the defacto complainant to the first accused trust. The transactions are of the year 2015-16. A1 had also issued some cheques in favour of the defacto complainant and the same were dishonored on https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL OP(MD). No.10334 of 2019 presentation. A2 has been arrested and since granted bail. The primary allegations are only against A2 and not against this petitioner.

4.Hence, this Court is inclined to grant anticipatory bail to the petitioner herein with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate Court No.II, Dindigul and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police daily at 10.30 A.M for a period of three weeks from today and thereafter he shall appear before the respondent police as and when required for interrogation.

5.The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. Scrupulously. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy is made ready, failing which, the petition for anticipatory bail shall stand dismissed. sd/- 03/09/2019 / TRUE COPY / Sub-Assistant Registrar (C.S.)
