ORDER : The Court Made the following order :- The petitioner/ accused no.5, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 379 of IPC and Section 21(1)of Mines and Minerals Act, seeks anticipatory bail.

2. Heard both sides.

3.The learned counsel appearing for the petitioner has submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in https://hcservices.ecourts.gov.in/hcservices/ 1/2

He further submitted that as per the FIR, the petitioner herein has illegally transported six units of river sand and hence, he prayed for grant of anticipatory bail to the petitioner. 4.The learned Additional Public Prosecutor would submit that the petitioner along with other had illegally transported six units of river sand. He further submitted that ten previous cases are pending against the petitioner, out of which eight cases relating to illegal sand mining. Hence he opposed to grant anticipatory bail to the petitioner.

5. Taking into consideration of the aforesaid facts and also the submission of the learned Government Advocate(Crl.Side) that ten previous cases are pending against the petitioner, out of which eight cases relating to illegal sand mining, this Court is not inclined to grant anticipatory bail to the petitioner.
